New Danish law on mandatory electronic time registration for companies – SAP time management solutions

As summer approaches, Danish workplaces must be prepared to handle time registration and reporting for all employees. Employers must ensure that working hours are recorded electronically for virtually all categories of employees. The law establishes requirements regarding transparency of employee registrations, storage of records, and the calculation basis for average weekly working hours. The registration system must meet the requirements of being “objective, reliable, and accessible.” The purpose of this extension of the Working Time Act is to ensure that employees’ rights within the EU regarding rest periods and maximum weekly working hours are respected and can be documented.

Not only will this requirement force a large proportion of Danish companies – large and small, across all industries and sectors – to upgrade their existing time registration systems, and in many cases implement entirely new ones, but all of this must be accomplished within a relatively short timeframe. For many organisations, these requirements mean immediate action is necessary to ensure compliance before the new law takes effect, as time registration can be a complex matter.

The law does not explicitly specify how time registration must be carried out, apart from the requirement that the system must be objective, reliable, and accessible. However, the Danish Ministry of Employment has confirmed in a written response that the law will not require registrations to include information about when during the day the work was performed, but only the employee’s total daily working hours.[1]
